Law is a mandatory tool for governing citizens and their actions in every country.
Accountants as other citizens should familiarize themselves with the laws of their country to
avoid sanction. Law refers to conduct rules with a binding force which are prescribed by the
controlling authority (Miller, 2015). It declares what to do and what not to do so that everybody
can be aware of what the law expects from them in a state. Law has a binding force in that the
citizens must follow it and in case they break or disrespect the law; there are fines and penalties
associated with it. The law is said to have a conduct character of a rule in that it commands the
rights and the wrong. This essay explains and compares the constitutional law, administrative
and civil laws and the relevance of these laws into the accounting discipline.
Constitutional laws are fundamental rules of a state which set the base for formulating
other laws (Nussbaum, 2010). These rules are contained in a written, or unwritten constitution
made and accepted by the biggest number of the citizens of a country. According to M. Kamto,
Constitution acts a central point of the legal system (Mason & Stephenson 2015). In the US, we
have the state constitutions which are made by a state and federal Constitution that followed by
every state. The federal constitution acts as the focal point of any US law and in case anything
conflicts with it, it will be impermissible. It requires that any state that wants to make new laws,
cannot give fewer rights, but it can provide more freedom than the federal constitution. The
government is required to abide by these laws in their actions and when making rules. For
example, the Constitution does not allow theft practices.
Administrative law is a branch of public law that governs the government administrative
agencies activities Like adjudication, rulemaking or enforcements of regulatory agenda. It deals
with the decision-making of governments unit in the administration line, and that makes up the
regulatory scheme such transport, taxation, and immigration (Parsons, 2017). These rules operate

independently, and in some countries, the disputes of administrative nature are adjudicated in
administrative courts.
Civil laws are fundamental laws in the society, and they contain rules that govern the
social conduct example marriage and divorce. This rules usually prohibits anti-social conducts
and behaviors that deviate the acceptable social behavior (United States "Stand your ground",
2015). The main aim of this rules is to ensure that the society is moving on smoothly by shaping
the behavior of the people in such a way that they benefit the community. In the US the
governments have worked to its level best to ensure that the society is heading in the right
direction. The Civil justice system, courts are usually available to adjudicate any liability relating
to civil law. This system ensures that those who break this rules example thieves are fined and
punished under the set laws. The main aim of the court in civil system is not to punish the person
who has broken it but to compensate the injured party.
Like any other citizen, in the accounting discipline, it requires the accountant to be aware
of the constitutional, administrative and civil laws so that they can avoid fines, penalties, and
punishment. By knowing the constitutional law, accountants can know what the country requires
from them and the procedures to follow in case of a government issue. The civil laws help the
accountants to have a good relationship with the society and the administrative law requires the
accountant abide by rules and regulation set.
